Plaintiff says in 2021, Four Mile paid $47.5 million to buy a 212-unit apartment building, Rivers Edge at Manchester downtown, from Reynolds South, built in 2018 by Purcell. Plaintiff says as part of due diligence, it asked defendants to describe how the property was built to prevent water leaks, and defendants represented that they had identified the source of leaks, that the property was built in compliance with its design, that they would repair leaks, and that they would warrant the repair of leaks that they intended to complete prior to closing. Plaintiff says defendants explicitly represented the exterior walls included DensGlass sheathing, flashing and waterproof barrier, when in reality the exterior walls were not built with the sheathing or waterproofing, and defendants were aware of this at all times. Plaintiff says the building has experienced ongoing water leaks, and in 2023 a structural engineering firm reported the property was not built in accordance with its design and the exterior walls did not include sheathing, flashing or waterproof barriers. Plaintiff alleges fraud and breach of contract and says it is faced with enormous costs to fix the property, and seeks $30 million in damages.
