Plaintiff says beginning February 2020, Youngblood provided civil engineering design for The Arbors at Hull Street project, an apartment complex designed for seniors. Plaintiff says as part of the scope of the work, Youngblood and Werner designed the stormwater management system and were to perform construction administration and management for the project. Plaintiff says the design for January 2020 and January 2022 site plans, which were approved by the city, was that the site would have two separate stormwater management systems that would connect and be pumped into the existing sewer system along Hull Street Road. Plaintiff says after construction began, they determined the representations by defendants were incorrect, with one of the basins not having the right to connect to the ditch, and defendants redesigned the plan and construction commenced. Plaintiff says Andrew Browning, president of Youngblood, took over the project from Werner (whose license was revoked by the Virginia Board of Architects, Professional Engineers, Land Surveyors, Certified Interior Designers and Landscape Architects) on/about June 18, 2024, and in October Browning informed plaintiff that there were issues that required revisions to approved plans and a redevelopment of the stormwater management system. Plaintiff says after retaining AES Consulting Engineers, it was determined that the underlying calculations for the original plan were faulty, and the design and redesign was flawed from the outset. Plaintiff says they are unable to complete construction for the project in a timely and proper fashion due to the faulty design and are forced to revise the site plans, losing valuable developable land. Plaintiff alleges professional malpractice and fraud and seeks damages of $14 million.
